General conditions of sale

Preamble

The online merchant site www.manufrance.fr is published and operated by SARL MANUFRANCE DISTRIBUTION. These terms and conditions are entered into between, on the one hand, SARL Manufrance Distribution, RCS of Saint Etienne No. 380 872 747, located at 6 rue de Lodi in Saint Etienne (42 000), and also referred to as the seller, and on the other hand, the natural or legal persons making a purchase via the website www.manufrance.fr, referred to as "the customer" or "the buyer". For professionals, the creation of an account is required in advance, by the sales department of Manufrance Distribution (04. 77. 21. 29. 92) (serviceclients@manufrance.fr). These general terms and conditions of sale (GTC) determine the rights and obligations of the parties in the context of the online purchase of products and services offered by the seller. The customer has the option to save or edit these T&Cs; this is their sole responsibility.

I/ APPLICATION

These General Terms and Conditions apply to any electronic order placed by the customer via the website www.manufrance.fr, or via a smartphone or tablet application, or by telephone at 04.77.21.29.92, or by mail to our head office address. Any order placed on the site implies full, unreserved and unconditional acceptance of the General Terms and Conditions in force on the day of said order. They are concluded for the duration necessary for the supply of the goods and services subscribed to, until the expiration of the guarantees.

II/ PRODUCTS

The essential characteristics, prices and delivery times of the products and services are indicated on each product sheet. The photos are provided for illustrative purposes. The total or partial impossibility of using the products, in particular due to incompatibility with equipment already in the customer's possession, will not give rise to any refund or liability from the seller.

III/ PRICE, AVAILABILITY AND DELIVERY TIMES

The products and services offered on the site are valid for the duration of their display on the site www.manufrance.fr. If an ordered product turns out to be unavailable, the customer is informed; he is offered either a refund or a product of equivalent quality and price. Prices are inclusive of all taxes, eco-participation included and excluding delivery costs or any option. These costs are invoiced in addition and are indicated before the order is validated. Products will be invoiced based on the price in effect on the site at the time the order is validated by the customer. For products shipped outside the European Union and DROM-COM, the price is calculated excluding taxes on the invoice. Delivery times are approximately 3-4 working days from the date the order is validated by the seller, except in the event of a shortage. In this case, the delivery time is indicated on the product sheet. If the seller notices a delay in delivery, he will notify the customer by email.

IV/ ORDERS

The customer declares that he has full legal capacity to enter into a legal contract under French law, or to validly represent the natural or legal person for whom he is acting. The seller accepts orders placed through his website, via a smartphone or tablet application, by telephone, by email, or by mail. Sales of weapons, spare parts, and ammunition are made only to adults who undertake to comply with mandatory legal requirements, providing detailed information about themselves and the official documents requested. In order to validate his order, the customer must confirm it using the so-called "double-click" technique: that is, after selecting products added to the basket, the customer must check and possibly correct the contents of the basket (namely, in particular: identification and quantity of selected products, corresponding prices, delivery terms and costs), before validating it, accepting these General Terms and Conditions, and fulfilling his obligation to pay for the order, thus confirming the acceptance of his order. The customer always has the option to return to previous pages or cancel their order. After receiving the order, the seller will send the customer an email confirming receipt of the order. Customers are advised to keep a copy of their order.

V/ PAYMENT

Payment is due immediately upon ordering. It can be made by credit card, check, or bank transfer. Cards issued by banks located outside France must be international cards (Mastercard, Visa, American Express, Carte Bleue). Online payment by credit card is secure. It is carried out by our payment service provider. The information transmitted is encrypted and cannot be read during transport over the network. It is neither recorded nor used and only reaches our banking institution directly. The commitment to pay by card is irrevocable (art. L132-2 of the Monetary and Financial Code), by transmitting their banking information, the customer authorizes the seller to debit their card for the amount of the transaction, and confirms that they are the legal holder of the card. Payment is debited after verification of the information. In the event of an error or an impossible card debit operation, the sale is resolved and the order canceled. Any order paid by check or bank transfer will only be processed upon receipt of the means of payment. In this case, availability and shipping times are to be recalculated from the date of receipt of the payment method. In case of payment by check, the customer must include a copy of their order form, or at least the order number, with their payment. Checks must be issued by a bank domiciled in France.

VI / SHIPPING AND DELIVERY

The products are delivered to the delivery address indicated when ordering. In the event of the customer's absence at the time of delivery, a delivery notice will be issued. In the event that the address indicated when ordering is incorrect or incomplete, the reshipping costs incurred as a result of these errors are the responsibility of the customer. At the customer's request, the professional may or may not take out insurance. The risk of loss is insured, and the customer will be reimbursed after investigation by the carrier. The customer must check the delivery in the presence of the carrier. In the event of missing or damaged items, the customer must refuse the package and make the usual reservations on the receipt and immediately notify the seller's customer service. (Please note: statements such as "subject to unpacking" or "subject to verification" are not accepted by insurance companies. If the delivery person refuses to attend the unpacking of the product, the following must be stated on the delivery slip: "the delivery person refused to attend the unpacking of the product". The customer will then be reimbursed immediately for the full amount of their payment, and at the latest within thirty days of payment. The customer is informed that the absence of such reservations on the delivery slip constitutes a presumption of compliant delivery of the products. In the event of sending by post, if the package arrives open or damaged, it is essential that the customer issues a "report of anomaly" (report 170) to the delivery person or the post office within 72 hours of receipt. The consumer must report the incident within 48 hours to the seller, attaching a copy of the report of anomaly so that the seller can open an investigation and a compensation procedure. In the event of relocation of an order by the buyer, to a country other than metropolitan France, the seller cannot be held liable, it is therefore up to the buyer to check with the competent local authorities, the possibilities of importing and using the products intended to be shipped there. If the customer orders several products, these may have different delivery times. An invoice is attached to the package. For customers wishing delivery outside metropolitan France, it is necessary to contact the sales department of Manufrance Distribution. For products shipped outside the European Union and DROM COM, customs duties or other taxes may be payable, they are the responsibility of the customer, the latter is therefore invited to inquire with the competent administrations and services. Concerning weapons, only shipment with insurance is possible. The customer is asked to obtain a quote for this service, the amount of which depends on the value of the weapon.

VII/ RETURN

The seller may be exempt from all or part of its liability if the non-performance of the contract is not attributable to it. If the customer has not refused delivery, they may return the product if it is defective. Regardless of the reason for return, the customer must contact the seller so that a reshipping solution can be offered. They must then return the product(s) intact at their own expense, in their original packaging and in perfect condition. They must then indicate the reason for the return. Any product returned without prior consultation with the seller will not be subject to a compensation study.

VIII/ RIGHT OF WITHDRAWAL

In accordance with the law, article L221-18 (right of withdrawal) of the Consumer Code, the buyer has a period of fourteen calendar days from receipt of the products to exercise his right of withdrawal. He must contact the seller's customer service (04 77 21 29 92) or serviceclients@manufrance.fr. In the event of exercising the right of withdrawal, the full price of the returned product(s) will be refunded by the seller. Return costs remain the responsibility of the customer. The customer must return the product, in its original packaging, in a clean and undamaged condition, such that it can be resold in new condition, and accompanied by proof of purchase. IX/ LEGAL GUARANTEES OF CONFORMITY AND HIDDEN DEFECTS

The seller applies the two legal guarantees:

  • The legal guarantee of conformity provided for in articles L217-4 et seq. of the Consumer Code which applies within a period of two years from delivery of the product for new product(s) and six months for used product(s).
  • The legal guarantee against hidden defects provided for in Articles L 1641 to 1649 of the Civil Code which applies within two years from the discovery of the defect.

The seller also applies a commercial warranty (provided for in Articles L 211-15 to L 211-16-1 of the Consumer Code) announced on the product sheet. The product(s) is/are guaranteed for parts and labor for a period of one year from the date of invoicing. For new weapons, the commercial warranty extends for 5 years and for used weapons it is six months. It does not cover damage resulting from misuse or modification and/or repair carried out by third parties.

If the delivered product(s) is/are deemed non-compliant by the customer or if it/they present hidden defects, the customer must send an email to the following address: serviceclients@manufrance.fr to notify the non-compliance or hidden defects of his/her product(s) and receive instructions from customer service. Upon receipt of the instructions, the customer returns the non-compliant product(s) or affected by a hidden defect to the address indicated by customer service. The product(s) must be returned complete, unused, in its/their original packaging intact and, if possible, accompanied by its/their original packaging as well as the return slip and a photocopy of the invoice. Furthermore, the seller does not accept packages sent postage due. Any risk related to the return of the product(s) is the responsibility of the customer. Upon receipt of the product(s) presumed to be non-compliant or affected by a hidden defect, the seller will carry out an inspection of the product(s) to determine whether or not said products are compliant. Similarly, the seller may carry out a quality test on the product(s) returned by the customer to verify that the returned product(s) are indeed original products. It is understood that these inspections will be carried out as soon as possible and within a maximum period of one month. If the non-compliant nature of the product(s) is confirmed or the hidden defect is proven, the customer may choose between repair and replacement of the product(s), subject to the cost conditions provided for in Article L. 217-9 of the French Consumer Code. If repair or replacement is impossible, the customer may choose between cancellation of the sale or a reduction in the sale price in accordance with Article 1644 of the Civil Code.

X/ COMPUTERS AND FREEDOMS

According to the French Data Protection Act of 6 January 1978, amended by the Act of 6 August 2004, the customer has the right to access, query, rectify and object to their personal data. By accepting these General Terms and Conditions, the customer agrees that their personal data may be used to fulfill this contract. By providing their email address, they may receive offers from the seller and its partners. They may object to their personal data being used for prospecting purposes, including commercial purposes, by the current data controller or the controller of subsequent processing. They simply need to activate the link at the end of the emails received or contact the seller. The automated processing of information on the website www.manufrance.fr has been declared to the French National Commission for Information Technology and Civil Liberties.

XI/ FORCE MAJEURE

The seller shall not be held liable for non-performance of the contract concluded in the event of force majeure. Force majeure is an unforeseeable, insurmountable, and external situation in the eyes of the parties, preventing them from fulfilling their obligations. The party that cannot fulfill an obligation due to a case of force majeure is released from it. The seller will inform the customer of the occurrence of such a case as soon as possible.

XII/ RIGHTS AND PROPERTY

All texts, images, logos and trademarks reproduced on the site are reserved under intellectual property rights and for the entire world. These General Terms and Conditions do not imply any transfer of intellectual property rights over these images, texts, logos and trademarks. Only use in accordance with the intended purpose of the site is authorized. Internet users who have a personal website and who wish to place, for personal purposes, on their site a link to the home page of the seller's site, must obtain written authorization from Manufrance Distribution. Hypertext links to the site www.manufrance.fr must be removed at the first request of Manufrance Distribution. All clauses of these General Terms and Conditions and all purchase and sale transactions referred to therein are subject to French law. Any disputes will be brought before the competent French courts.
